These Terms and Conditions govern access to and use of nobiajtae.com, owned by Nobiajtae Capital Inmobiliario S.A.S., an Ecuadorian company with tax ID (RUC) 1793612480001 and domiciled in Quito, Ecuador. By using the site you accept these terms in full.
1. Purpose
The site nobiajtae.com is an informational and interest-collection channel for the real estate crowdlending activity that Nobiajtae carries out in Ecuador. The contracting of loans takes place within the private platform after identity verification and the signing of specific contracts.
2. Nature of the information
The information published is of a general nature and does not constitute personalised financial, tax or legal advice. Each person must assess their own situation and, where applicable, consult independent advisors in Ecuador.
3. Registration and verification
To operate as an investor or developer you must register, provide accurate information and complete the KYC process required by UAFE. Nobiajtae may reject registrations or suspend accounts when it identifies unusual or unjustified operations.
4. Risks
Real estate crowdlending involves risks, including arrears, mortgage foreclosure and partial capital loss. It is not a bank deposit and is not covered by Ecuador’s deposit insurance. Past returns do not guarantee future results.
5. Intellectual property
All content on the site (texts, graphics, logos, trademarks and code) is owned by Nobiajtae or its licensors. Reproduction, distribution or transformation without written authorisation is prohibited.
6. Permitted use
You agree to use the site in accordance with the law, good faith and public order. It is forbidden to: (i) attempt to breach the security of the site; (ii) perform unauthorised automated scraping; (iii) use the site to promote unlawful activities.
7. Limitation of liability
To the maximum extent permitted by law, Nobiajtae shall not be liable for indirect damages, loss of profit or lost opportunities arising from the use of the site. We do accept liability for wilful misconduct, gross negligence and for obligations expressly assumed in contracts signed inside the platform.
8. Links to third parties
The site may include links to third-party websites. Nobiajtae does not control nor assume responsibility for their content, policies or practices.
9. Modifications
We may modify these terms for legal, technical or commercial reasons. The current version will always be published on the site with its update date.
10. Governing law and jurisdiction
These terms are governed by the laws of Ecuador. Any dispute will be brought before the ordinary courts of Pichincha, without prejudice to non-waivable rights recognised to consumers.
